Federal Court Orders Freedom of Abrego Garcia from ICE Custody

A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks lawful basis.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The situation originates in a erroneous deportation to El Salvador in March, which the government later acknowledged was an error. After his return to the United States to answer alien smuggling allegations, he was held in immigration custody.

In her decision, the judge noted that the government does not have a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."

The court challenge involve disputed claims. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.
